Images and video shown on this website for the purpose of analysis and commentary are not owned nor are they licensed to “The Critical Architect”.

This site operates under the protection of “Fair Use” as defined in U.S. Code Title 17 Section 107 for images obtained and used for purposes of news, information, analysis and criticism. This section of the Copyright Act states:

§ 107 · Limitations on exclusive rights: Fair use

Notwithstanding the provisions of sections 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include—

(1) the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;

(2) the nature of the copyrighted work;

(3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and

(4) the effect of the use upon the potential market for or value of the copyrighted work.

The fact that a work is unpublished shall not itself bar a finding of fair use if such finding is made upon consideration of all the above factors.

  2. Provide alternate image or video that is acceptable to “The Critical Architect” that maintains the intent of the project and criticism of that project.

“Criticism” by its very nature may be offensive to the person receiving the criticism. This is a fundamental part of life and our society. There is no Constitutional right to not be offended by others and for good reason. It is the act of criticism that pushes us to achieve greater success.

In every case, my commentary and criticism shall be intended and received as my personal opinion. The reader is invited to agree or disagree at will and is invited to convey their thoughts (respectfully) in kind on this or other websites of their own creation.

My comments are not intended to be slanderous (libel), inflammatory or to cause harm in any way. All comments made on this site are intended and shall be received as “My Personal Opinion” and in no way reflect upon the skill, ability or character of any person or entity. I make no endorsements or recommendations (for or against) any person, business or service. My comments and critical analysis are intended to better the profession of Architecture by providing a third party, non-partisan viewpoint which may lacking from those who are closest to the project.

This site provides for the opportunity and means to publish responses, explanations and rebuttals without censorship.
